Terms of Service – Goldener Wahl

Section 1 – Scope of Application

These Terms of Service apply to all orders placed through our online shop (goldenerwahl.com) between you as a consumer and us:

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.

Section 2 – Contract Conclusion

  1. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
  2. By clicking the order button, you submit a binding order.
  3. The contract is concluded only upon our order confirmation via email or upon dispatch of the goods.
  4. We do not store the contract text. However, you can print your order data via the order completion page.

Section 3 – Prices and Payment Terms

  1. All prices listed are in Euros (€) including statutory value-added tax (VAT) for EU customers.
  2. Shipping costs are shown separately and can be viewed in the shopping cart.
  3. Price changes apply only to future orders. The price valid at the time of order is binding.
  4. Payment is made via credit card, PayPal, Klarna, or Sofortüberweisung through Shopify Payments.

Section 4 – Delivery and Shipping

  1. We ship worldwide.
  2. Processing time: 1–2 business days after payment receipt (excluding weekends and public holidays).

  1. Order tracking: You will receive a tracking number via email after dispatch.
  2. Customs & taxes: No additional customs duties within the EU. Outside the EU, the recipient bears all applicable import duties.

Section 4a – Right of Withdrawal (Statutory)

Right of Withdrawal

You have the right to cancel this contract within fourteen (14) days without giving any reason.

The cancellation period is fourteen (14) days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of cancellation, you must inform us:

of your decision to cancel this contract by an unequivocal statement (e.g., a letter sent by post or email). You may use the model cancellation form, but it is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of cancellation

If you cancel this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen (14) days from the day on which we receive your cancellation notice. For this repayment, we shall use the same means of payment as you used for the original transaction, unless expressly agreed otherwise; in no event shall you be charged any fees for this repayment.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen (14) days from the day on which you communicate your cancellation of this contract to us. The deadline is met if you send back the goods before the period of fourteen (14) days has expired.

As a voluntary service, Goldener Wahl covers all return shipping costs. You will receive a free prepaid return label — you pay nothing for the return shipment.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Section 5 – Voluntary 30-Day Return Guarantee

In addition to your statutory right of withdrawal, we offer a voluntary 30-day return guarantee.

This voluntary return guarantee does not affect your statutory rights and applies in addition to them.

Conditions for the voluntary guarantee:

  • Items must be unworn, unused, with all original tags attached, and in the original packaging.
  • Proof of purchase (order number) is required.
  • Custom-made items are excluded from this voluntary guarantee.

Return shipping costs:
Goldener Wahl covers all return costs for returns under the voluntary guarantee. You will receive a free prepaid return label.

Restocking fee:
We do not charge any restocking fees.

Refund:
Approved refunds will be credited to your original payment method within 5–10 business days after receipt and inspection of the return.

Please note: This voluntary guarantee does not replace or restrict your statutory right of withdrawal under Section 4a.

Section 6 – Statutory Warranty

The statutory warranty provisions of German law (§§ 434 ff. BGB) apply.

If the purchased item is defective, you are entitled to subsequent performance (repair or replacement) free of charge, in accordance with the statutory provisions.

Return shipping costs for warranty claims are covered by Goldener Wahl. Please contact us at info@goldenerwahl.com to arrange the return.

In the event of a defect, please contact us immediately. We will handle your claim promptly and in accordance with the law.

The warranty period for used goods is limited to 12 months if we have expressly agreed to this. For new goods, the statutory warranty period remains unchanged.

The limitation period for claims for defects is two years from the delivery of the goods, unless otherwise provided by law.

Section 7 – Retention of Title

The goods remain our property until full payment has been made.

Section 8 – Liability

  1. We are liable for damages resulting from injury to life, body, or health based on an intentional or negligent breach of duty.
  2. For other damages, we are liable only in cases of intent or gross negligence.
  3. We are not liable for damages caused by improper handling or use of the goods.
  4. Liability under the Product Liability Act remains unaffected.
  5. We strive for accuracy of product information but note that individual information may be temporarily incorrect. In the case of obvious errors, we reserve the right to withdraw from the contract.

Section 9 – International Shipping and Returns

  1. The 30-day return period also applies to international customers.
  2. Customs duties and taxes on international orders are not refunded by Goldener Wahl. These can be reclaimed directly from your local customs authority.

Section 11 – Jurisdiction and Applicable Law

  1. The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. For lawsuits against consumers, the place of jurisdiction is the consumer's place of residence. For lawsuits by consumers against us, Wiesbaden, Germany, is the place of jurisdiction, to the extent legally permissible.
  3. This clause does not apply to consumers residing outside Germany if mandatory legal provisions of their home country contradict it.

Section 12 – Severability Clause

Should any provision of these Terms of Service be invalid, the validity of the remaining provisions shall remain unaffected. The statutory regulation shall replace the invalid provision.
